Mr. Gregory Basso -2- <br /> The owner or operator of an interim status facility <br /> shall submit his closure plan to the Department at <br /> least 180 days before the date he expects to begin <br /> closure. <br /> Termination of interim status (except when a permit is <br /> issued to the facility simultaneously with termination <br /> of interim status) . 4 <br /> The facility does not have a closure plan and has not <br /> submitted said plan to DOHS. <br /> Section 25159.5 (b) Health & Safety Code states that: <br /> Until the time when all standards and regulations which <br /> are determined necessary by the United States <br /> Environmental Protection Agency for final authorization <br /> of the state program under Public Law 94-580 have been <br /> adopted by the department and filed by the Secretary of <br /> State as effective, all regulations adopted pursuant to <br /> Public Law 94-580, as amended, are in affect in this <br /> state, except that existing state laws or regulations <br /> which are more stringent than the corresponding federal <br /> regulations are also in effect in this state. <br /> Violation #3 Section 265.92 (a) Code of Federal Regulation <br /> Title `40. <br /> The owner or operator must obtain and analyze samples ' <br /> from the installed groundwater monitoring system. The <br /> owner or operator must develop and follow a <br /> groundwater sampling and analysis plan. He must keep <br /> this plan at the facility. The plan must include <br /> procedures and techniques for: <br /> (1) Sample collection; <br /> (2) Sample preservation and shipment; <br /> (3) Analytical procedures; and <br /> (4) Chain of custody control. <br /> The facility has not developed and followed a <br /> groundwater sampling and analysis plan. <br /> Violation #4 Section 265.92 (b) Code of Federal Regulations <br /> Title 40. <br />
