Mr. Gregory Basso -5- <br /> The facility has not determined vertical gradient of <br /> prepared hydrogeological cross sections. Without this <br /> information the facility can not determine the <br /> facilities impact on the quality of ground water in the <br /> uppermost aquifer. <br /> Violation #8 Section 265.93 (a) Code of Federal Regulation <br /> Title 40. <br /> Within one year after the effective date of these <br /> regulation, the owner or operator must prepare an <br /> outline of a ground-water quality assessment program. <br /> The outline must describe a more comprehensive <br /> groundwater monitoring program (than that described in <br /> 265.91 and 265.92) capable of determining: <br /> (1) Whether hazardous waste or hazardous waste <br /> constituents have entered the groundwater; <br /> (2) The rate and extent of migration of hazardous <br /> waste or hazardous waste constituents in the <br /> groundwater; and <br /> (3) The concentrations of hazardous waste or hazardous <br /> waste constituents in the groundwater. <br /> The facility has not prepared an outline of a <br /> groundwater quality assessment program. <br /> II. Schedule for Correction <br /> Violation 1 shall be corrected immediately. <br /> Violation 2 , 3,4,5, 6,7 and 8 shall be corrected by June 1, <br /> 1986. <br /> Please send written certification, which contains the <br /> sample certification statement indicated on the <br /> enclosed sheet, to this office as soon as the above <br /> corrections have been completed. <br /> The Department will conduct a re-inspection of Forward <br /> Inc. , Stockton, CA 95206 to verify compliance. <br /> The issuance of this Notice of Violation and Schedule <br /> for Compliance does not preclude DHS from taking <br /> administrative, civil, or criminal action as a result <br /> of the violations noted herein. <br />
