Box 6336 <br /> Stockton, California 92506 <br /> RE: FINANCIAL ASSURANCE MECHANISM FOR CORRECTIVE ACTION FOR THE <br /> FORWARD LANDFILL, FACILITY NO. 39-AA-0025 <br /> Dear Mr. Caprio: <br /> This letter provides information regarding financial assurances for known or reasonably <br /> foreseeable corrective action. Staff of the California Integrated Waste Management Board <br /> (CIWMB)reviewed the annual inflation factor report for 1997 for the subject facility. The report <br /> shows corrective action estimated costs of$143,473. As you are aware, Title 27, California <br /> Code of Regulations, Division 2, Subdivision 1, Chapter 6, Subchapter 2, Article 4, section <br /> 22221, Forward is required to demonstrate financial responsibility, to the CIWMB, for initiating <br /> and completing corrective action for all known or reasonably foreseeable releases from the <br /> subject facility. - <br /> CIWMB staff realizes Forward may not yet have provided a corrective'action plan to the <br /> Regional Water Quality Control Board (RWQCB). Therefore, Forward will not be required to <br /> make the demonstration to the CIWMB until a plan and estimates have been approved by the <br /> RWQCB. <br /> RWQCB staff indicated that the RWQCB does not require a financial assurance demonstration <br /> for an ash pits unless hazardous waste has been disposed of in the pit. The CIWMB has no <br /> financial assurance requirement for ash pits. If Forward and the RWQCB conclude the eastern <br /> ash pit fits this category (no hazardous waste disposed of in the pit), then no financial assurance <br /> demonstration for closure/postclosure maintenance for the pit is required. After the corrective <br /> action plan and estimate for the subject facility has been developed, Forward may wish to <br /> consider using the eastern ash pit trust fund (Union Safe Deposit Bank account#26002037286) <br /> California Environmental Protection Agency <br /> Printed on Recycled Paper <br />
