SAN JOAQUIN <br /> <br />Environmental Health Department <br />• --COUNTY <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: YRC <br />Date: Oct 06, 2022 <br />RP Mailing Address: 1535 E PESCADERO AVE <br />Record ID#: CO5FPDOM1 <br />TRACY, CA 95304- <br />Program Element: 2546 <br />Spill Location: 1535 E PESCADERO AVE, TRACY Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />At approximately 9.10pm October 6, 2022, San Joaquin County Environmental Health (EHD) received notification that a <br />gasket on the fuel metering system was worn out and began to leak releasing approximately 75 gallons of diesel fuel onto <br />the pavement and dirt at 1535 East Pescadero Ave , Tracy. <br />OBSERVATIONS: <br />EHD arrived on site and made contact with the equipment Manager ll and observed the impacted area approximately 15 by <br />6 feet, the leak had stopped. Absorbents and booms were applied on the impacted concrete. The equipment Manager <br />stated that some diesel fuel went to the strip drain onto the oil/water separator. A cleanup company (ANCO) is en route for <br />cleanup. <br />Clean up the impacted area. Make a hazardous waste determination for any hazardous waste material generated from the <br />clean up operation and dispose of them as required and provide results and disposal records to EHD. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing therefor, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. <br />[FISC25189.5(a)]. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />1: Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />° Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />1: Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />• Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />Immediately. <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev, 9/16/2020 Page 1 of 2 <br />1868 E.
