SAN '�d DAQ II II Environmental Health Department <br /> C0L.IJT`o' <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> CHINCHIOLO STEMILT CALIFORNIA 4799 N JACK TONE RD, STOCKTON April 11, 2023 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15. <br /> -The business plan was not submitted for calendar year 2020 and 2021. <br /> -The business plan was submitted incomplete for calendar years 2019. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Submit statement to SJC EHD ensuring that the business plan will be annualy submitted <br /> by the January 15th due date. <br /> This is a minor violation. <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br /> OBSERVATION: <br /> The following changes observed on-site and have not been updated within 30 days. <br /> -The facility added to their site inventory 1,370 gallons of gasoline.The site map was not updated to include the <br /> chemical locaiton. <br /> -The site map submitted to CERS under the Plans section was updated to include four evacuation areas. The <br /> current map submitted to CERS under the inventory section in CERS only include one evacuation area. <br /> -The emergency plan information uploaded to CERS has outdated information. Lary Stonebarger, Roger Pepperl, <br /> and Pat Lucio are no longer part of the crisis management team, but they are still listed for emergency contact. <br /> REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br /> information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d)Change business ownership <br /> e)Change of business name <br /> f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the <br /> business plan. <br /> (2)For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit <br /> immediate response during an emergency by either site personnel or emergency response personnel, or that could <br /> inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br /> or impede implementation of the business plan. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> FA0010393 PR0520289 SCO01 04/11/2023 <br /> EHD 19-01 Rev.12/06/2021 Page 2 of 3 Hazardous Materials Program OIR <br /> 1868 E.
