SAN ,JOAQUIN <br /> Environmental Health Department <br />COJ Ni 'Y <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br /> <br />Responsible Party: GREENVIEW FARMS INC Date: May 07, 2021 <br />RP Mailing Address: 130W INVITAR LN Record ID#: CO5ISMEIV <br />MOUNTAIN HOUSE, CA 95391- Program Element: 2546 <br /> <br />Spill Location: 0 MANILA RD, LATHROP <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />THE RESIDUAL OF APPROXIMATELY 200 CONTAINERS OF PESTICIDES, HERBICIDES, AND FUNGICIDES WERE <br />RINSED INTO AN APPROXIMATELY 800 FOOT OVERFLOW WATER RESERVOIR. <br />OBSERVATIONS: <br />Received notification from Augustine Diaz (Office of the Agricultural Commissioner) reporting the dumping of pesticides, <br />herbicides, and fungicides into a ditch. Met with Augustine and property owner Sandeep Singh on site. Per Augustine, <br />there were approximately 200 containers of pesticides that were cleaned up prior to the EHD's arrival and are pending <br />proper disposal. Per Augustine the pesticide containers were being rinsed into the property's overflow water reservoir. Per <br />owner Sandeep, the reservoir does not have an outlet and the water will evaporate. The reservoir is not lined. <br />The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is not <br />permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous waste shall be <br />disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Stop rinsing pesticide containers <br />into the overflow water reservoir. Make a hazardous waste determination for the water inside the water reservoir and <br />dispose it as required, and provide proof of correction and/or copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E Hazelton Avenue I Stockton, California 95205 I T 209 468-3420 I F 209 464-0138 I www.sjgov.org/EHD
