NO PUBLIC WATERWAYS AFFECTED. SPILLED INTO AN <br />AREA WHERE WATER HAD POOLED (FROM RAIN) IN A MUDDY PARKING LOT. "BUTLER'S CLEAN SWEEP" IS <br />GOING OUT TO CLEAN IT. <br />OBSERVATIONS: <br />This report was amended <br />EHD received CalOES spill report #22-7282. Arrived on site at approximately 5:30pm and was let inside the premises by <br />Dylan Chaum, facility security guard. Observed red coolant in the area where spill occurred, measuring approximately 4ft by <br />3 ft. Per Fabian Speed, the clean up was conducted by Butler's Clean Sweep and all waste generated was taken by the <br />clean up company. No manifest was provided and it was unknown how waste was going to be disposed of at the time. I <br />informed Fabian that clean up had not been completed because red coolant was still visible in the impacted area. <br />Per Fabian, clean up has been completed as of 12/13/2022 by Butler's Clean Sweep and the wastes were actually taken to <br />the Central Valley Waste Management facility and the liquid waste was put in the facility's oil-water separator. <br />Conduct hazardous waste determination for the wastes generated and provide final disposal records for all wastes <br />generated to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />Failed to determine if a waste is a hazardous waste. Any person who generates a waste shall determine if the waste is <br />a hazardous waste as specified in Title 22 California Code of Regulations (CCR) 66262.11. Immediately make a <br />hazardous waste determination for the waste, and manage it according to Title 22 CCR. Use Safety Data Sheets <br />(SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. Waste <br />testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and <br />supporting documentation with your hazardous waste determination. <br />If the material is deemed hazardous waste, then per California Health and Safety Code 25163, a person must hold a <br />valid registration to transport the waste. Please also note that workers who handle hazardous materials need to be <br />trained per Title 8 California Code of Regulations 5192: Hazardous Waste Operations and Emergency Response <br />(HAZWOPER).
