One bag of absorbent was used which generated <br />1/4 of a 55 gallon drum of waste. The waste was then transported to the BNSF Mariposa Yard where it is going to be picked <br />up for disposal by an outside vendor. No waterways or storm drains were impacted by the spill. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />Per Title 22 California Code of Regulations (CCR) 66261.11, any person who generates a waste shall determine if the <br />waste is a hazardous waste. There are wastes that are listed as hazardous wastes. There are wastes that exhibit one <br />or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. <br />Immediately make a hazardous waste determination for the red dye diesel waste and manage it according to Title 22 <br />CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous <br />waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections <br />66261.20-24. <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit a statement, supporting documentation showing how the hazardous waste determination was made, and <br />disposal records to the San Joaquin County Environmental Health Department.
