<br />Environmental Health Department SAN JOAQUIN <br />NT sr" <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PENSKE TRUCK LEASING <br />Date: Sep 09, 2021 <br />RP Mailing Address: ROUTE 10, GREEN HILLS, PO BOX 7635 <br />Record ID#: C00054241 <br />READING, PA 19603- <br />Program Element: 2546 <br />Spill Location: 0 D ARCY PKWY, LATHROP <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 20 gallons of diesel was released due to a damaged diesel tank, around 5 gallons was released into the <br />storm drain. <br />OBSERVATIONS: <br />EHD recieved a spill notification of 20 gallons of diesel fuel due to a ruptured semi truck saddle tank on D'arcy Parkway in <br />Lathrop. Approximately 300 ft by 2 ft trail of diesel fuel was observed on the southern shoulder of Darcy Parkway. <br />Approximately 5 gallons of diesel was spilled in the storm drain. No soil was impacted. City of Lathrop power washed and <br />vacuumed the storm drain. The liquids retrieved from the storm drain will be disposed of as hazardous waste. Further storm <br />drain cleaning is required, due to observed dark staining on the sidewall. City of Lathrop and Penske applied absorbents to <br />some of the diesel spill area. A damn of absorbent was created to stop further liquids from entering the storm drain. <br />Greymar Environmental services has been contracted by the responsible parties spill broker for clean up. At this time, the <br />spill has not been secured. Provide disposal records of any hazardous waste generated from clean up operations. <br />VIOLATIONS: <br />° Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />lmmediatly <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
