Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: CO8JEDNEI Site Location: 1901 S EL DORADO ST, STOCKTON CA 95206 <br />Activity Summary <br />Activity Date <br />04/07/2023 <br />Recorded by <br />The EHD received CalOES spill report #23-2483 regarding a spill that took place GARCIA-MEJIA <br />on 1/9/2023 at 1901 S El Dorado St.,Stockton CA 95206. The caller stated that he <br />was extracting contaminated fuel at the listed location and when he went to <br />remove the fuel hose the valve was still open causing the release of approximately <br />50 gallons. Per the caller, the fuel was released onto the asphalt as well as the <br />storm drain on site. The driver of the vehicle was covered in gasoline and was <br />transported to the hospital. Per the caller, the release was cleaned up by Van De <br />Pol. <br />I called Larry Ramos (209-380-8694), reporting party, and left a voice mail. <br />I called Susana Ferreira (209) 300-3488, store manager at 1901 El Dorado to <br />inquire about the release. Susana stated she did not know anything regarding the <br />release but called her boss Avinash Singh on a three-way call. Avinash did <br />remember the incident and he stated that the release was caused by the driver of <br />Van De Pol and that Van De Pol was on site to conduct the clean up and that they <br />filled drums with waste and took it. Susana provided me with the Van de Pol <br />contact phone number for Sarah (209-649-9382). I called Sarah but received no <br />answer. <br />Obtained Van de Pot's environmental contact phone number via CERS, Kristen <br />Dugger (209-689-5530) and spoke with her about the spill. Kristen stated that the <br />spill was not 50 gallons but in fact closer to 20-25 gallons. Per Kristen the reason <br />they did not report the spill was because it was under the 42 gallon reportable <br />quantity. I informed Kristen that the 42 gallons only applies to highways and that <br />we consider any release a reportable quantity and this spill should have been <br />reported. Per Kristen the driver was sprayed with a small amount of fuel and was <br />taken to the hospital but returned back to work the next day. Per Kristen no storm <br />drains were impacted and she stated she looked at the storm drain and did not <br />observe a sheen. Per Kristen approximately half of a 55-gallon drum of waste was <br />generated with pads. They left the drum on site without a label, she obtained an <br />EPA ID number and went back to the facility the next day but the drum had been <br />stolen. <br />I received a call back from Larry Ramos. Larry is the delivery driver and he stated <br />that he accidentally added 87-grade fuel to the 91-grade tank and therefore was <br />vacuuming it out. He went to disconnect the hose but didn't realize the valve was <br />still open and that is what caused the release. Per Larry, he was soaked in fuel <br />from head to toe and went into the restroom to wash his eyes and face. He said <br />that fuel was released into the asphalt and the storm drain. According to Larry he <br />called his supervisor who did not answer so he called another facility contact <br />requesting back up. Larry said it took about 3 hours and a half for Van de Pol to <br />send out staff to conduct clean up and to take him to the hospital and according to <br />Larry the reason they came out was because he told them he was going to call the <br />fire department. He was taken to the emergency room where he was given a <br />shower and sent home. Larry stated that he called Kristen Duggar the next day to <br />let her know what time he left the ER and that Kristen stated they were on site <br />conducting clean up until 4:30 am and that a vacuum truck was used to clean up <br />the storm drain. Larry stated he suffered chemical burns and was prescribed a <br />cream by his primary care doctor and that his vision was hazy for a few days after. <br />Larry also mentioned that he was written up for the incident and was given a final <br />warning but that today is his last day and he is not afraid of retaliation. <br />I generated a complaint and added the spill report to the ER complaint excel <br />sheet. I called Kristen to inform her that I would be creating a complaint and all <br />time associated to this issue would be chargeable. Completed the Prop 65 and <br />printed it out.
