During each attempt the EHD inspectors were told that
they would not be allowed to inspect the facility. They were told to return when you were available. The
contact information of both inspectors was left at the facility along with registration form for the facility
and the artist that are currently working there.
The EHD has not received the registration forms or any contact from you. This letter serves as a follow-
up to the attempted inspection and as a guidance document for your facility operation. In 1997, Assembly
Bill 186 was passed. The bill required that every practitioner of tattooing, body piercing, and permanent
cosmetics register in the county in which they practice and require the practitioners to pay registration and
inspection fees as specified. The bill also required county health departments to annually inspect the
locations where tattooing, body piercing, and permanent cosmetics are practiced.
Currently there are proposed draft rules that are being worked on and their approval is anticipated some
time in 2009. Listed below are some guidelines that you need implement pursuant to the draft rules.
Develop an Infection Prevention and Control Plan that includes procedures for cleaning and
disinfection of the work areas, and equipment that have come in contact with clients including
chairs, armrests, tables, countertops and trays. The work areas and equipment shall be
immediately decontaminated after each use.
The disinfectant used by the facility must be a U.S. Environmental Protection Agency (EPA)
registered disinfectant that is label tuberculocidal.
The biological indicator (spore) testing results for the facility's autoclave should be stored onsite
to show testing has been performed. The spore test shall be run at least monthly. The spore
testing results must be kept at the facility for the past two years.
Each procedure and cleaning area shall have a container for the disposal of sharps waste that is
rigid, puncture resistant, leak proof on the sides and bottom and closeable and sealable so that
when sealed, the container is leak resistant and incapable of being opened without great
difficulty. The sharps waste container shall be labeled with the words "sharps waste" or with
the international biohazard symbol and the word "BIOHAZARD".
