Y44#064 1s Oar Am* <br /> This agreement is made between the "Customer" (billing name below); hereafter, referred to as "Customer"; and Barnett Medical <br /> Services, Inc., hereafter, referred to as "BMS" . <br /> Billing Name : T nys Ink <br /> Billing Address: ' 228 West Yosemite Avenue, Manteca, California 95336 <br /> Service Address: SAME <br /> Contact Person : Solomon Barbosa Email : ' tinysinkayahoo.com <br /> Tel #: 516-719-0726 FAX # Hours: 9am-5pm <br /> Standard Terms and Conditions <br /> DEFINITIONS: Except where the context of this agreement indicates otherwise, the following words and phrases when used in this <br /> agreement shall be given the respective meanings set forth below (a) Facility- means a permitted treatment facility, is located in <br /> Stockton Ca or such other treatment facility as shall be designated by Barnett Medical Services (b) Bio Medical waste- means <br /> infectious sharps, hypodermic needles, syringes, microbial cultures, tissue cultures, animal tissues, laboratory containers and slides <br /> that meet the definitions of regulated medical waste under federal, state, and local regulations and guidelines (c) Non-Conforming <br /> waste- means (i) anywaste or other material not falling within the definition of Biomedical waste, (II)fetal remains and human <br /> torsos; (iii) radioactive, corrosive, reactive, ignitable or toxic wastes and any and all hazardous wastes and substances as defined in <br /> any applicable federal, state, county, or municipal laws, regulations, and guidelines.; (iv) RCRA characteristic waste which has an <br /> alcohol base that makes the mixture ignitable. Non-Conforming Waste shall also include improperly classified and/or improperly <br /> packaged Bio Medical waste and any waste identified as unacceptable under the BMS waste acceptance protocol in effect duringthe <br /> term of this agreement. (d) Excluded waste- means any waste by means of its composition, characteristic, or quantity is ineligible for <br /> disposal at the BMS processing facility under any applicable law, rule, regulation, or permit, specifically (a) fetal remains and human <br /> torsos, (b)corrosives, re-actives, radioactive, toxic, volatile, explosive and other hazardous waste substances defined in any <br /> applicable federal, state, county or municipal laws, regulations and guidelines, (c) thermometers, or other materials containing <br /> mercury, (d) aerosol cans or other containers of compressed gas, (e) controlled substances, (f) bulk trash, construction debris, and <br /> office equipment and (g)and waste the thermal oxidation of which would damage BMS equipment or would lead to a violation of <br /> any law, rule, regulation, or permit condition . <br /> Article 1- DISPOSAL SERVICES <br /> 1. BMS shall treat and/or dispose of Clients Bio Medical waste or incineration waste provided that such waste is packaged and <br /> labeled in accordance with this agreement and all applicable federal, state, and local laws regulations, and ordinances and <br /> BMS protocols <br /> 2. BMS reserves the right to decline to accept for treatment any biomedical waste or incineration waste which, in BMS's <br /> judgement, it cannot treat and /or dispose of in a lawful manner without risk of harm to public health or the environment. <br /> Improperly packaged., leaking, or damaged containers are subject to rejection or off-specification charges for repackaging <br /> and or special handling. <br /> Article 2- CLIENT OBLIGATIONS <br /> 1. Client shall package and label all Bio Medical waste and incineration waste in accordance with all federal, state, and local <br /> laws, regulations and ordinances and in accordance with BMS's permits. <br />
