OBSERVATION: The designated operator employee training for Sarajuddin Saraj was not performed. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. This is a Class II violation. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: The diesel tank was converted to bio-diesel approximately mid-May and a permit was not obtained from the EHD. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the change of product for tank#3 from diesel to bio-diesel . A"Failure to Obtain a Permit" penalty applies. This is a minor violation. 318 CCR 2635, 2637.1,2665, 2712 Failed to meet spill container requirements. OBSERVATION: The premium direct-bury spill container failed when tested. REGULATION GUIDANCE:All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. CORRECTIVE ACTION: Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately,there is a possibility that the premium UST system may be red tagged to prevent fuel inputs. This is a Class II violation.
