OBSERVATION: The VMI leak detector was replaced with a Red Jacket and a permit was not obtained from the EHD. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the VMI replacement. A"Failure to Obtain a Permit"penalty applies. This is a minor violation. 308 CCR 2632(c), 2634(d), 2636(f) Failure of the leak detection equipment to have an audible and visual alarm. OBSERVATION: The float and chains in the 1-2 UDC failed to stop the flow of product at the dispenser when tested. REGULATION GUIDANCE:All monitoring equipment shall be maintained to activate an audible and visual alarm or stop the flow of product at the dispenser when it detects a leak. CORRECTIVE ACTION: Correct immediately by having a properly licensed,trained, and certified contractor replace the failed component with a functional component(LG 113-x listed, if applicable), and obtain a permit within one business day from the EHD, if needed. If the failed component can't be replaced immediately,there is a possibility that the 87 UST system may be red tagged to prevent fuel inputs. This is a repeat violation, Class II. 318 CCR 2635, 2637.1,2665, 2712 Failed to meet spill container requirements. OBSERVATION: The 91 premium direct-bury spill container failed when tested. REGULATION GUIDANCE:All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. CORRECTIVE ACTION: Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately,there is a possibility that the 91 premium UST system may be red tagged to prevent fuel inputs. This is a repeat violation, Class II. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 8/18/2023.
