SAN JOAQUIN <br />1,41,14.) —COUNTY— <br />. dislczor, <br />. occo;tY Greatness nrows here <br />Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: VELOCITY RAIL SOLUTIONS <br /> Date: Feb 21, 2021 <br />RP Mailing Address: 121 S ELECTION RD #130 <br /> Record ID#: C031SZOIY <br />DRAPER, UT 84020- Program Element: 2546 <br />Spill Location: 720 S B ST, STOCKTON <br /> Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />A locomotive was overfilled causing the release of approximately 15 gallons of red-dyed diesel fuel. <br /> <br />OBSERVATIONS: <br />Red-dyed diesel was released onto asphalt from locomotive 175 on the west side of the yard. The spill area was <br />approximately 10x15 feet. The area was pressure washed by the responsible party for partial cleanup. An oily sheen was <br />observed on top of the pressure washed area. The pressure wash water went underneath the train. US Ecology was hired <br />by the property owner to complete the cleanup and properly dispose of the waste. The waste generated from the incident is <br />going to be left on site while a hazardous waste determination is performed. No storm drains or water ways were observed <br />impacted. <br /> <br />VIOLATIONS: <br />LI Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />° Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />Per Title 22 California Code of Regulations (CCR) 66261.11, any person who generates a waste shall determine if the <br />waste is a hazardous waste. There are wastes that are listed as hazardous wastes. There are wastes that exhibit one <br />or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. <br />Immediately make a hazardous waste determination for the red-dyed diesel waste and manage it according to Title 22 <br />CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous <br />waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections <br />66261.20-24. <br /> <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Submit a statement, supporting documentation showing how the hazardous waste determination was made, and the <br />final disposal records to the San Joaquin County Environmental Health Department. <br />° Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev 9/16/2020 Page 1 of 2 <br />1868 E.
