WHEN <br />SHE RETURNED HOME SHE FOUND THAT THE CAKE WAS ALLEGEDLY ROTTEN. COMPLAINANT ALSO STATES <br />THAT SHE BOUGHT NOODLES AND FOUND THAT THE EXPIRATION DATE WAS DATED 2016 <br />VIOLATIONS AND CORRECTIVE ACTIONS <br />Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; <br />113700. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health <br />and have the potential to cause foodbome illness. All major violations must be corrected immediately. Non-compliance may warrant immediate closure of <br />the food facility. <br />OVERALL INSPECTION NOTES AND COMMENTS <br />FOOD ITEM — LOCATION --TEMP ° F -- COMMENTS <br />No Temperature Data Collected <br />COMMENTS AND OBSERVATIONS <br />Complaint inspection. No major violations. No re-inspection. <br />Operator aware of complaint. Per operator, customer was sold a cake and operator told customer to smell it and look at it to <br />see if everything is ok when they bought the cake. Customer said everything was ok and purchased cake. Customer came <br />back two days later and said the cake was rotten and asked for a refund. No receipt for the cake was provided. Customer <br />became angry and threw the cake on the ground of the store and also the parking lot. Entire incident was recorded on security <br />cameras. Cakes at the store were not observed with any type of adulteration or spoilage. Packaged noodles during the <br />inspection did not have expired use by dates. <br />Official inspection report was emailed to operator. <br />To minimize person-to-person contact, the signature of the person receiving the inspection report was not captured. <br />The person in charge is responsible for ensuring that the above mentioned facility is in compliance with all applicable sections of the California Health and <br />Safety Code.
