The local Unified Program Agency <br />(UPA) phone number on line C1 is incorrect. The local UPA phone number is 209-468-3420 and should be entered <br />on line C1. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The inventory section was <br />submitted late on 1/21/2020 for the year of 2020. The business plan was submitted late on 1/22/2021 for the year of <br />2021. The business plan submittal for the years of 2022 and 2023 have been made on time. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 2 violations found during the <br />inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 8/31/2023. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($162).
