DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-OOXX 21 <br /> FORWARD, INC. <br /> FORWARD LANDFILL <br /> SAN JOAQUIN COUNTY <br /> 60. On 21 May 2015, the Discharger submitted a Nutrient Management Plan to <br /> demonstrate site-specific data that would justify an increase in nitrogen loading <br /> for the cannery waste operation in the land application area. In response to the <br /> 2015 Nitrogen Management Plan and violations of the WDR limits on 27 June <br /> 2016, the Assistant Executive Officer issued a Water Code section 13267 Order <br /> for Technical Reports, requiring the Discharger to submit a Cannery Waste Land <br /> Application Area Compliance Plan and a Nutrient Management Plan to address <br /> nitrogen loading exceedances. <br /> 61. On 10 April 2017, CAO R5-2008-0714 was rescinded except for enforcement <br /> purposes and the Executive Officer issued Cleanup and Abatement Order R5- <br /> 2017-0703 requiring the Discharger to conduct additional investigations to <br /> delineate the vertical and lateral extent of the release from the landfill, install <br /> corrective action systems to control and capture the migration of contaminates, <br /> enhance the groundwater treatment system, and address violations associated <br /> with over-loading of nitrogen in the cannery waste land application area. <br /> Compliance with CAO R5-2017-0703 is ongoing. In order comply with the CAO, <br /> the Discharger has proposed to install four extraction wells, six piezometers, and <br /> three groundwater monitoring wells on the adjacent CDCR property. The <br /> groundwater extraction system is expected to be operational by the Summer of <br /> 2023. Additionally, the Discharger is required to sample residential domestic <br /> supply wells for VOCs. See Table 3 and Attachment H for residential domestic <br /> wells included in the sampling program. <br /> 62. On 20 June 2016, a Notice of Violation for Acceptance of Hazardous Waste was <br /> issued. Forward Landfill accepted and buried hazardous waste on several dates <br /> between April 2014 and December 2015. <br /> 63. On 16 May 2017, Water Code section 13267 Order for Enhanced Monitoring was <br /> issued for failure to remove hazardous waste. <br /> 64. On 2 March 2018, a Notice of Violation for Acceptance of Hazardous Waste was <br /> issued for the illegal acceptance of hazardous waste. Acceptance of the <br /> hazardous waste was identified by the LEA as approximately 9 tons of lime <br /> mixed with debris and soil associated with a Union Pacific Railroad cleanup <br /> action. <br /> 65. On 9 May 2018, a Notification of Release to the Discharger was issued for the <br /> Forward Landfill WMU. <br /> 66. On 8 September 2018, the Discharger submitted an alternative source <br /> demonstration report to DTSC and addressed the statistically significant <br /> exceedance of organic and inorganic constituents of concern in groundwater <br /> wells downgradient from WMU A.
