Memorandum TETRA TECH <br /> defined by the Porter-Cologne Act as"any surface water or groundwater, including saline waters, <br /> within the boundaries of the state" (State Water Resources Control Board [SWRCB] 2019).These may <br /> include intermittent or ephemeral waters.The ephemeral pond was also assessed for presence of a <br /> lake or pool, measured to the top of bank or edge of riparian vegetation,that is subject to California <br /> Department of Fish and Wildlife(CDFW)jurisdiction under Section 1602 of the Fish and Game Code. <br /> The pond is mostly unvegetated,with approximately one percent cover of sprouting doveweed <br /> (Croton setigerus) and black mustard (Brassica nigra) along the edges. No wetland vegetation was <br /> observed. Vegetation on the adjacent,gradual slopes next to the ephemeral pond include non-native <br /> grasses,such as wall barley(Hordeum murinum), rye grass(Festuca perennis), brome (Bromus spp.), <br /> and California burclover(Medicago polymorphs). <br /> Wetland hydrology was observed due to the presence of surface water which was approximately 1 to 2 <br /> feet deep and surface soil cracks where the surface water has evaporated. <br /> Hydric soil was observed due to the presence of redox dark surface (F6) and redox depressions(F8) in <br /> each surface layer(0 to 2 inches;2 to 6 inches;and 6 to 15 inches).The soil was primarily clay/loam <br /> with 10 YR,v4/cl and 10 YR,v3/cl coloration. <br /> The ephemeral pond is not a USACE wetlands due to the lack of hydrophytic vegetation.This feature <br /> is not a Waters of the U.S. because it is hydrologically isolated. However, it is likely jurisdictional to the <br /> RWQCB and CDFW. <br /> 3.2 Railroad Underpass Along West Patterson Pass Road <br /> There is a 20-foot4ong paved road under the railroad tracks bridge (Attachment B). There are steep <br /> dirt berms on the east and wide side of the road. Consistent vehicle traffic was noted along the road. <br /> CTS may be able to climb the dirt berm,cross the paved road with vehicle traffic,then use the road <br /> under the railroad tracks bridge to access nearby grassland areas. Therefore,the Union Pacific <br /> railroad is not a complete barrier to CTS migration, but rather is a partial barrier. <br /> 3.3 Standing Water West of Midway Road <br /> The standing water observed west of Midway Road within 150-meters of the site has the potential to <br /> support vernal pool invertebrates.Aerial imagery indicates that this feature holds water regularly, <br /> although ephemerally. However, no standing water was observed in this feature during June 2023, <br /> which may indicate that standing water is not present long enough for the entire vernal pool <br /> invertebrate lifecycle. Regardless,this area is outside of the Project footprint on the opposite of a <br /> paved roadway and will not be impacted directly or indirectly by proposed activities. <br /> 3.4 Ditch South of West Patterson Pass Road <br /> A shallow ditch that is located on the south side of West Patterson Pass Road within the 150-meter <br /> buffer was observed by Tetra Tech during 2022 surveys and by MIG during their April 2023 site visit. <br /> This ditch was mapped by Tetra Tech during the June 2023 site visit and has been added to Figure 1 in <br /> Attachment A.This ditch ranges from 1 to 8 feet wide and was mostly dry,except for standing water <br /> observed at one location north of the railroad and next to the road near the end of the feature.The <br /> 3 J u ly 2023 <br />
