Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />September 06, 2023 <br /> Facility Address: <br /> 1109 W anderson ST, STOCKTON <br /> Facility Name: <br /> SEACA PACKAGING, INC. <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business last made a <br />submittal on 11/30/2016. The business has not made submittal for the years of 2018, 2019, 2020, 2021, 2022, and <br />2023. The business moved in the year 2022 and was under old CERS ID # 10183827 prior to 2022. The business <br />made a new submittal on 9/6/2023 and the violation was corrected on site. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, Kathleen Valves stated that the business moved to the facility in 2022 but <br />has not been updated in CERS. The business has not updated and submitted the information within 30 days in the <br />California Environmental Reporting System (CERS). This violation has been corrected. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br />or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br />FA0005692 PR0520362 SC001 09/06/2023 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 4 of 6 <br />1868 E.
