Mail <br /> 22637 Sixth St. PR0504245 <br /> Hayward, CA 94541 <br /> Subject: Removal of animals from 21800 S Manteca Rd., Manteca CA 95337 (APN 226-120-12) <br /> The Environmental Health Department (EHD) conducted a routine inspection at the above referenced property on <br /> December 13 , 2021 . A variety of animals were observed housed at the northeast corner of the property, near the <br /> perimeter fence. On April 7, 2021 , EHD had a conversation with the owner of the animals, Charles Powell, <br /> regarding relocating the animals off site. Mr. Powell was informed that the animals cannot be kept on the property <br /> due to improper handling/ disposal of manure on the site and due to the disturbance of the integrity of the final <br /> cover by these animals. On June 30, 2021 , during a quarterly inspection, Mr. Powell stated the animals will be <br /> relocated in two weeks, as of yet, the animals remain on site and no changes have been made. <br /> The Title 27 California Code of Regulations (T27CCR), Section 21190 requires that the site is to be maintain non- <br /> irrigated open space. The rearing of animals would be considered a Post-Closure Land-Use (PCLU). All PCLU <br /> activities must have prior approval. Mitigations/restrictions must be in place prior to approval of PCLU. The <br /> existing cover on the site is not an approved cover described in T27 CCR Section 21140. The rearing of animals <br /> does compromise the integrity of the existing cover and may require the installation of a more prescriptive final <br /> cover. <br /> Therefore, effective immediately remove and relocate all animals from the premises.
