RIGHT OF ENTRY AGREEMENT <br /> THIS RIGHT OF ENTRY AGREEMENT ("Agreement") dated as Oct 2,2022 <br /> , 2022 (the "Effective Date") is entered into by and between the San Joaquin <br /> Regional Rail Commission ("SJRRC"), and Hazelton Church Stockton, LLC ("Grantor"). <br /> SJRRC and Grantor may each be referred to as a "Party" or collectively as the "Parties." <br /> RECITALS <br /> A. Grantor is the owner of that certain real property located at 1021 E Hazelton Ave, <br /> Stockton, CA(APN 15128003) as more particularly depicted in Exhibit A ("Property"). <br /> B. SJRRC wishes to enter the Property to perform and environmental investigation <br /> and geotechnical investigation on the Property. <br /> C. The geotechnical investigation will comprise of a single, three-inch diameter <br /> boring at approximately the location identified as "CPT-8" in Exhibit B, attached hereto and <br /> incorporated herein by reference ("Geotechnical Investigation"). The Geotechnical <br /> Investigation will take place on a single day and take approximately 6-8 hours. Once the boring <br /> is complete, the hole will be grouted and capped with asphalt concrete. A County inspector will <br /> sign off on the work. <br /> D. The environmental investigation will comprise of two, three-inch diameter, <br /> approximately 11 foot deep borings at the locations identified in Exhibit C, attached hereto and <br /> incorporated herein by reference ("Environmental Investigation" and, together with the <br /> Geotechnical Investigation, the "Work")). The Environmental Investigation will take place over <br /> the course of two days. On the first day, SJRRC contractors will meet with a private utility <br /> locator to mark the boring locations and identify underground utilities. That work is estimated to <br /> take approximately one hour. On the second day, SJRRC contractors will mobilize a drill rig to <br /> drill the two borings and take soil and water samples for laboratory analysis. The boreholes will <br /> be grouted and capped with concrete or asphalt concrete (whatever is required to conform to the <br /> existing condition). The Grouting operations will be observed by San Joaquin County <br /> Environmental Health Department representative. The work on the second day is estimated to <br /> take approximately 6-8 hours. <br /> E. The Parties enter into this Agreement to memorialize the terms by which SJRRC <br /> will enter and use the Property. <br /> AGREEMENT <br /> NOW, THEREFORE, for good and valuable consideration, receipt of which is hereby <br /> acknowledged, the Parties hereby agree as follows: <br /> 1.
