Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />September 20, 2023 <br /> Facility Address: <br /> 244 W HARDING WAY, STOCKTON <br /> Facility Name: <br /> MIRACLE MILE MARKET <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: When asked, the store clerk was unable to state what would be done in the case of discharge of <br />gasoline. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a repeat violation, Class II. <br /> 19 HSC 25404.1.2 Failed to submit a certification and written response within 30 days for minor violations. <br />OBSERVATION: This facility was inspected on 12/9/2020. The inspection report was delivered to this facility on <br />12/10/2020. A complete Return to Compliance Certification form was not received by the San Joaquin County <br />Environmental Health Department (EHD) within 30 days of inspection report delivery. <br />REGULATION GUIDANCE: (c) (1) A person who receives a notice to comply detailing a minor violation shall have <br />not more than 30 days from the date of the notice to comply in which to correct any violation cited in the notice to <br />comply. Within five working days of correcting the violation, the person cited or an authorized representative shall <br />sign the notice to comply, certifying that any violation has been corrected, and return the notice to the San Joaquin <br />County Environmental Health Department (EHD). <br />(e) If a person who receives a notice to comply pursuant to subdivision (a) disagrees with one or more of the <br />alleged violations listed on the notice to comply, the person shall provide the EHD a written notice of disagreement <br />along with the returned signed notice to comply. If the person disagrees with all of the alleged violations, the written <br />notice of disagreement shall be returned in lieu of the signed certification of correction within 30 days of the date of <br />issuance of the notice to comply. <br />CORRECTIVE ACTION: Submit a corrective action statement to the EHD within 30 days. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection.
