Please find attached the RFI amendment package for the Tracy Material Recovery and Transfer Station. I <br /> have included a submittal letter describing our response to comments provided and a standalone copy <br /> of the signed application form, also provided in Appendix A. <br /> My apologies for the late submittal. I was not aware that your unique process for a 5-year permit review <br /> required both the review of the previous submittal and completion of the RFI Amendment process <br /> within the review timeframe. Having completed this process several dozen times with numerous LEAs, <br /> every other jurisdiction, including where CalRecycle is the EA, completes the review of the initial <br /> submittal and files their review report, advising the operator of the need for an RFI amendment, if <br /> necessary. In all other cases, the RFI amendment process proceeds on a separate timeline following the <br /> review. I have never heard of a permit "expiring", as stated in recent inspection reports, if the review <br /> process is delayed; in fact, I have worked to expedite my efforts when LEA's missed permit review dates <br /> and had to conduct the review after the date had passed. Again, my misunderstanding is the reason this <br /> was delayed. <br /> In regards to the use of the food depackaging equipment, the previous versions of the TPR were <br /> carefully negotiated with Natalia and Robert McClellon to allow that use of the equipment once it was <br /> installed.
