OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste transported from the site in the past three years. The missing receipts include: 100 gallons of used oil removed from the facility on 09/10/2021 REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. This is a Class II violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: Oily stains were observed under the drums containing unknown material in the storage building, indicating a leak from the drum(s). REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. CORRECTIVE ACTION: Immediately stop the release and clean-up the impacted area. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up waste. This is a Class II violation. 401 CCR 66262.34(d)(2) Failed to store hazardous waste in a container that is in good condition. OBSERVATION: Hazardous waste was found stored on-site in containers that are not in good condition. Oily stains were observed under the drums containing unknown material in the storage building, indicating a leak from the drum(s). REGULATION GUIDANCE: Hazardous waste shall be stored in a containers that are in good condition. If a container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in good condition, or manage the waste in some other way that complies with the hazardous waste requirements. CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation.
