The facility generates used oil from the ammonia system. The <br /> contractors(SMI)who maintained the system previously used to manage the used oil disposal.There were no <br /> records on-site/log indicating how much oil was disposed of. There were no disposal records for used oil for the last <br /> three years. SMI does not have a hazardous waste permit with the county. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Maintain the records on-site for three years from the date of shipping and provide a copy <br /> to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a <br /> statement to the EHD that future receipts will be maintained on-site for three years. <br /> This is a Class II violation. <br /> 601 CCR 66262.34(d)Stored hazardous waste onsite greater than 180 days(90 days acute/extremely). <br /> OBSERVATION: 55 gallons drum of used oil found on-site with no accumulation start date.Another 55 gallons drum <br /> of used oil observed on-site with accumulation start date greater than 180 days(10/29/2019). <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66262.34. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in <br /> compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the <br /> disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> 605 CCR 66262.34(f) Failed to completely label containers or portable tanks of hazardous waste. <br /> OBSERVATION: 55 gallons drum of Used Oil observed on-site without the labeling.The drum has the words <br /> "waste oil"on it but did not have the words"Hazardous Waste", name and address of generator, hazardous <br /> properties, physical state, and accumulation start date. <br /> REGULATION GUIDANCE: All hazardous waste containers shall be marked with the following information: the <br /> words"Hazardous Waste", name and address of generator, hazardous properties, physical state, composition <br /> (contents), accumulation start date <br /> CORRECTIVE ACTION: Immediately label the containers as required for hazardous waste.
