Per Matt Stine, the containers are pending determination by their contractor to decide if they are in <br /> good enough condition to return to their inventory, returned to the manufacturer, or disposed as hazardous waste. <br /> Per Matt,the contractor is only at the facility once a week. Onsite personnel do not make hazardous waste <br /> determinations, only the contractor who comes out once a week. <br /> REGULATION GUIDANCE: <br /> 22 CCR 66261.2-Definitions of a waste <br /> 22 CCR 66261.3-Definition of hazardous waste <br /> 22 CCR 66262.11 -A person who generates a waste, as defined in section 66261.2, shall determine if the waste is <br /> a hazardous waste. <br /> All hazardous waste containers shall be marked with the following information: the words"Hazardous Waste", <br /> name and address of generator, hazardous properties, physical state, composition (contents), accumulation start <br /> date <br /> CORRECTIVE ACTION: Make a hazardous waste determination for each waste , and manage it according to Title <br /> 22 CCR. Provide a copy of the facility's standard operating procedures for managing a hazardous waste when the <br /> contractor is not on site. <br /> This is a Class II violation. <br /> 104 CCR 66262.34(d)(2)No modified contingency plan. <br /> OBSERVATION: The facility contingency plan is missing some mandatory components. The missing component <br /> is:the CalOES number was not listed.
