Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />October 31, 2023 <br /> Facility Address: <br /> 1930 W FREMONT ST, STOCKTON <br /> Facility Name: <br /> DIRT MOVERS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />The 2020 business plan was not submitted. <br />The 2021 business plan was not submitted. <br />The 2022 business plan was submitted late on 5/11/2022. <br />The 2023 business plan was submitted late on 2/15/2023. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is a minor violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: Training records for the past three years were not available at the time of the inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were four violations during the <br />inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 11/30/2023. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign.
