S0 JOA U 1 Environmental Health Department <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: FDat,-.CARLS JR RESTAURANT#177 990 N Main St, MANTECA ber 31, 2023 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br /> OBSERVATION:A training program was not submitted in CERS. <br /> REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br /> shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br /> threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> These training programs may take into consideration the position of each employee. <br /> CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br /> Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, <br /> and submit to the EHD for approval. <br /> This was corrected on site. <br /> This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15. <br /> -The 2021 business plan was not submitted <br /> -The 2022 business plan was submitted on 6/2/2022-late <br /> -The 2023 business plan was submitted on 10/31/2023-late <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br /> annual HMBP to CERS by January 15. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection.
