DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-00XX 42 <br />FORWARD, INC. <br />FORWARD LANDFILL <br />SAN JOAQUIN COUNTY <br />142.The technical reports required under this Order, as well as those required under <br />the separately issued MRP, are necessary to ensure compliance with prescribed <br />WDRs and the provisions of Title 27, Subtitle D (40 C.F.R. part 258) and State <br />Water Board Resolution 93-62. Additionally, the burdens associated with such <br />reports are reasonable relative to the need for their submission. <br />143.Failure to comply with the reporting requirements under this Order and the MRP <br />may result in enforcement action pursuant to Water Code section 13268. <br />Procedural Matters <br />144.All local agencies with regulatory jurisdiction over land-use, solid waste disposal, <br />air pollution and public health protection have approved the use of the Facility’s <br />site for the discharge of waste to land as provided for herein. <br />145.The Discharger, interested agencies and interested persons were notified of the <br />Central Valley Water Board’s intent to prescribe the WDRs in this Order, and <br />provided an opportunity to submit their written views and recommendations at a <br />public hearing. (Wat. Code, section 13167.5; Title 27, section 21730.) <br />146.At a public meeting, the Central Valley Water Board heard and considered all <br />comments pertaining to the discharges regulated under this Order. <br />147.The Central Valley Water Board will review and revise the WDRs in this Order as <br />necessary. <br />REQUIREMENTS <br />IT IS HEREBY ORDERED, pursuant to Water Code sections 13263 and 13267, that <br />Forward Inc. a subsidiary of Republic Services Inc., their agents, employees, and <br />successors shall comply with the following. <br />A. Discharge Prohibitions—Except as otherwise expressly directed below, the <br />Discharger shall comply with all Standard Prohibitions (SPRRs, section C), which <br />are incorporated herein, as well as the following. <br />1.“Hazardous Waste,” as defined per Title 23, section 2601, shall not be <br />discharged at the Facility. The Department of Toxic Substances Control <br />(DTSC) shall be immediately notified of any such discharges in violation of <br />this Order. <br />2.Except as specifically authorized in Section B.1 and Table 16, <br />“Designated Waste,” as defined per Water Code section 13173, shall not <br />be discharged at the Facility.
