Because of the special circumstances applicable to the property , including size , shape , topography9the location , or surroundings , the strict application of the regulation deprives the property of privileges enjoyed by other property i <br /> vicinity and under identical zoning classification . <br /> Because this property is essentialy a residential structure serving the community as a commercial fire station , zoning classifications <br /> Fsh:o:u:1:d:a:1low for responsible growth when required to serve more effectively/efficiently the community it protects . Allowing <br /> a simple carport to be constructed near one property fence line will allow for the proper care and maintenance of very <br /> expensive and necessary life saving equipment . <br /> The proposed structure will provide a "class A" 2hour fire rated wall between both properties as required by the CBC . <br /> 2 . No Detriment. The Variance will not be detrimental or injurious to property or improvements in the vicinity of the subject property , <br /> or the public health , safety or general welfare . <br /> In no way will the construction cause any increase of potential hazzard to the community or surrounding properties . <br /> I leo Special Privileges . The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations <br /> upon other properties in the vicinity and zone in which the property is situated . <br /> There have been many instances in the surrounding neighborhood where permits have been issued for new ADU building <br /> sites with setbacks less than county requirements , provided fire rated classifications are met.
