The report was povided to the business on 04/21/2021. <br />REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br />written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br />subdivision (a) of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br />department or the local officer or agency may reasonably require, which shall include a statement documenting <br />corrective actions taken by the operator or proposing corrective actions which will be taken by the operator, for <br />purposes of compliance with this chapter, or disputing the existence of the violation. The local agency, the San <br />Joaquin County Environmental Health Department, requires response within 30 days. <br />CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br />County Environmental Health Department. <br />This is a repeat violation, Class II. <br /> 206 HSC 25160.2(c)(2) Waste stream or generator not eligible to use consolidated manifesting procedure. <br />OBSERVATION: This facility is releasing the following wastes for transport and disposal using the consolidated <br />manifesting procedure: fuel contaminated water. The disposal receipts are dated 12/01/2020, 12/14/2021, and <br />09/08/2022 for "used oil". Per manager Harjit Singh, the facility does not generate used oil. The only waste stream <br />are fuel contaminated water, fuel contaminated absorbent, and fuel filters. These wastes are not eligible for <br />consolidated manifesting. <br />REGULATION GUIDANCE: California Health & Safety Code section 25160.2 <br />CORRECTIVE ACTION: Immediately stop releasing the following wastes for transport and disposal using the <br />consolidated manifesting procedure: fuel contaminated water. Start using the Uniform Hazardous Waste Manifest <br />(UHWM) system for transport and disposal of hazardous waste not eligible for the consolidated manifesting <br />procedure. Provide a corrective action statement to the San Joaquin County Environmental Health Department <br />(EHD) within 30 days. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by December 28,2023. <br />Wastes generated by this facility: fuel contaminated water, fuel contaminated absorbent, and fuel filters.
