CONDITIONS OF APPROVAL <br /> PA-2200165 <br /> DALE R. & EILEEN J. KUIL TRUST I QUARTAROLI &ASSOCIATES, INC. <br /> Minor Subdivision Application No. PA-2200165 was approved by the Community Development <br /> Department on November 21, 2022.The effective date of approval is December 1, 2022. This tentative <br /> map approval will expire on November 30, 2025, which is 3 years from the effective date of approval, <br /> unless (1)all Conditions of Approval have been complied with and (2)a Certificate of Compliance has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance requirements <br /> cannot be modified, and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact: [209]468-3121) <br /> a. TENTATIVE MAP: The Final Map shall substantially conform to the approved tentative map dated <br /> August 11, 2022. <br /> b. WILLIAMSON ACT CONTRACT: The property owner shall rescind the current contract and shall <br /> enter into a new contract prior to recording the Parcel Map. The Parcel Map shall not be recorded until <br /> the Williamson Act Contract application has been deemed complete. Filing fees are required for this <br /> application. <br /> c. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> d. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> 1. Parcel 1 shall have a minimum lot width of 150 feet, measured at such distance back from the <br /> front lot line as is required for the depth of the front yard. (Development Title Section 9-610.4) <br /> 2. Parcel 1 shall be between 2 and 5 gross acres in size. (Development Title Section 9-610.4) <br /> e. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> The homesite shown on the Parcel Map as Parcel 1 shall not be transferred until November 30, <br /> 2032, or upon the death of an owner owning at least 50 percent interest in the homesite parcel, <br /> unless the homesite parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> The property shown on the Parcel Map as Parcel 1 is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin County <br /> Development Title. <br /> PA-2200165—Conditions of Approval 1 <br />
