CONDITIONS OF APPROVAL <br /> PA-2300280 AND PA-2300281 <br /> DNS INVESTMENT II, LLC <br /> Minor Subdivision Application No. PA-2300280, and Site Approval Application No. PA-2300281, were <br /> approved by the Community Development Department on May 21,2024.The effective date of approval <br /> is May 31, 2024.This approval will expire on May 31, 2027,which is 36 months from the effective date <br /> of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> permits have been issued and remain in force, and (3)all necessary permits from other agencies have <br /> been issued and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(CDD)(Staff Contact: Brad Wall,468-3160) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated October 5, 2023. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a separate instrument: <br /> i. All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniences or discomforts shall not be considered a nuisance. <br /> c. CONSISTENCY: Improvement plans and all subsequent development and building applications <br /> within the boundaries of this project approval shall be reviewed by the Community Development <br /> Department and Design Consistency Review Committee (DCRC) and found consistent with the <br /> Mountain House Master Plan, Specific Plan II, Mountain House Development Title, Development <br /> Agreement, and other applicable plans, standards and requirements prior to issuance of any <br /> discretionary approvals or ministerial permits. (Development Title Section 9-205M) <br /> d. BUILDING PERMIT: Submit an "APPLICATION-BUILDING PERMIT'. The Site Plan required as a <br /> part of the building permit must be prepared by a registered civil engineer or licensed architect. This <br /> Plan must show drainage, driveway access details including gates, on-site parking, landscaping, <br /> signs, existing and proposed utility services, and grading (refer to the"SITE PLAN CHECK LIST'for <br /> details).A fee is required for the Site Plan review. <br /> e. APPROVED USE: This approval is for a neighborhood commercial development comprised of a <br /> 3,460 square-foot single-story building for retail uses and a 7,350 square-foot daycare center.The <br /> project architecture follows the Italianate Architectural style that has been chosen for <br /> Neighborhood H of the Mountain House Specific Plan II area. The proposed project includes <br /> sufficient parking for the intended uses and the site design criteria meets the Mountain House <br /> Design Manual for Commercial development. These are the same general architectural plans the <br /> Mountain House Developers reviewed through the DRC review and approved on January 1,2024. <br /> The project site is located within Specific Plan II area. <br /> f. SUBSEQUENT APPROVALS: All subsequent discretionary and ministerial approvals for the <br /> project shall be subject to Design Consistency Review and shall be consistent with the Mountain <br /> House Commercial, Office and Industrial Development Design Manual.
