OBSERVATION:The three jet fuel tanks did not cause shutdown and do not meet the requirements for annual line tightness testing exemption during the inspection on 2/27/2023. REGULATION GUIDANCE:All pressurized piping with secondary containment shall be pressure tested at least once every 12 months at a minimum release detection of 0.1 gallons per hour at 150 percent of the normal operating pressure. Continuous monitoring systems that are fail safe and shut down the pump when a leak is detected, or optionally stop the flow of product at the dispenser if the leak is in the under dispenser containment (UDC), shall satisfy the requirement for annual line tightness testing. CORRECTIVE ACTION: Immediately schedule an annual line tightness test and provide 48 hours notification to the EHD. This is a Class II violation. 317 CCR 2636(f)(2) Failure of the line leak detector to detect a 3.0 gph leak at 10 psi and restrict or shut off flow. OBSERVATION: The jet fuel line leak detector for all three tanks were not tested during the time of inspection on 2/27/2023. REGULATION GUIDANCE:All line leak detectors shall be capable of detecting a 3-gallon per hour leak at 10 psi. CORRECTIVE ACTION: Immediately have a properly licensed,trained, and certified contractor repair or replace the failed leak detector(LG 113-x listed, if applicable)and obtain a permit within one business day from the EHD, if needed. If the failed leak detector can't be replaced immediately,there is a possibility that the jet fuel UST system may be red tagged to prevent fuel inputs. This is a Class II violation. 334 CCR 2670(b)(e)(f), 2671 Failure to comply with temporary closure requirements. OBSERVATION. Base on the report conducted on 2/27/2023, all three tanks were observed as empty.Temporary closure procedures were not followed. A.G. Spanos Jet Center, tank owner, states the UST system will be reused. REGULATION GUIDANCE: No person shall abandon or close or cease operating an UST system without complying with the requirements of HSC 25298. CORRECTIVE ACTION: Immediately obtain a permit from the EHD to temporarily close this UST system. A "Failure to Obtain a Permit"penalty applies. This is a Class I violation.
