FINDINGS FOR ADMINISTRATIVE USE PERMIT <br /> PA-2300248 <br /> PONDA ROCHA LAND CO LP/SAC WIRELESS <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Special Purpose Plan, Specific Plan, and Planned Development zone; and any <br /> other applicable plan adopted by the County. <br /> • This finding can be made because the proposed Telecommunications Tower and ancillary <br /> equipment may be conditionally permitted in the AG-40 (General Agriculture, 40-acre <br /> minimum) zone with an approved Administrative Use Permit application. The project site <br /> has a General Plan designation of A/G (Agriculture General), and the AG-40 zone is an <br /> implementing zone for this designation.Therefore,the proposed Telecommunication Tower <br /> is consistent with the goals, policies, standards and maps of the General Plan, and there <br /> are no Master Plans, Specific Plans, and/or Special Purpose Plans in the project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because there are no new utility or roadway improvements <br /> required. A Telecommunications Tower is an unmanned facility and will not impact existing <br /> public utilities. This project will not require the use of public water, or a septic system and <br /> all storm water will be retained on site. The proposed project will be accessed from Lone <br /> Tree Road. The Department of Public Works has provided Conditions of Approval that will <br /> ensure the proposed use is adequately served by highways and streets. There may be a <br /> slight increase in road traffic during the construction of the tower, but the facility is <br /> unmanned and will only require periodic maintenance visits after its construction. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 333.13-acre project site is of adequate size to <br /> accommodate the proposed use and the Site Plan shows that all setbacks, and other <br /> requirements of the Development Title can be met. According to the Federal Aviation <br /> Administration section§77.9,the only time the construction or alteration of a tower requires <br /> notice, is when it has an above ground level (AGL) measurement over 200 feet at its site. <br /> According to the Federal Communications Commission section § 1.61, there is no absolute <br /> limit for the height of antenna towers. However, the erection of an antenna structure <br /> exceeding 1, 000 feet in height must be accompanied by a statement from the Federal <br /> Aviation Administration that the proposed structure will not constitute a menace to air <br /> navigation.The proposed communication tower will not exceed 105 feet, which is below the <br /> height where a statement is needed for the Federal Aviation Administration. <br /> 4. The location, size, design, and operating characteristics of the proposed use will be compatible with <br /> and will not adversely affect the livability or appropriate development of abutting properties and the <br /> surrounding neighborhood. <br /> • This finding can be made because the proposed Telecommunications Tower encompasses <br /> a small area and is exempt from environmental review.The proposed project is a compatible <br /> use in the AG-40 zone and is not anticipated to adversely affect the livability or appropriate <br /> development of abutting properties and the surrounding neighborhood. <br /> 5. The proposed use will not create any nuisances arising from the emission of odor, dust, gas, noise, <br /> vibration, smoke, heat, or glare at a level exceeding ambient conditions. <br /> PA-2300248— Findings 1 <br />
