OBSERVATION: During the inspection, Jason Minjarez stated that Dane Treiber and Ben Alarca have not been with the business since 2023. Both Dane and Ben were listed as the primary and secondary emergency contacts. The business has not updated and submitted the information within 30 days. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2)For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility,or impede implementation of the business plan. CORRECTIVE ACTION: This was corrected on site by logging into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, entering the correct or updated information, and submitting to the EHD for approval. This is a Class II violation. 12 HSC 25505(c)Failed to have the HMBP readily available to facility or EHD personnel. OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon request. Employees do not have access to the Emergency Response Plan and the inventory information on-site. REGULATION GUIDANCE: The emergency response plans and procedures,the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section. CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. This is a minor violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were six violations during the inspection. Five violations were corrected on site. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 5/4/2024. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
