The facility has answered no to the"APSA"question <br /> under the CERS business activity section. <br /> REGULATION GUIDANCE: 25404(e)(4) No later than three years after the statewide information management <br /> system is established, each CUPA, PA, and regulated business shall report program data electronically. The <br /> secretary shall work with the CUPAs to develop a phase-in schedule for the electronic collection and submittal of <br /> information to be included in the statewide information management system, giving first priority to information <br /> relating to those chemicals determined by the secretary to be of greatest concern.The secretary, in making this <br /> determination shall consult with the CUPAs,the California Emergency Management Agency,the State Fire Marshal, <br /> and the boards, departments, and offices within the California Environmental Protection Agency. <br /> CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new(or any changes <br /> to existing)Aboveground Petroleum Storage Act(APSA)information online to the CERS at <br /> http://cers.calepa.ca.gov. Be sure to include your APSA activity in the Businesses Activities section in CERS in <br /> addition to any other relevant activities and required fields. Submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> 708 CFR 112.8(c)(2), 25270.4.5(a)Containment systems for bulk storage tanks are not sufficiently impervious to contain <br /> oil on site. <br /> OBSERVATION: The secondary containment for the aboveground storage tank contains at least 2 ft of water. The <br /> water contains sheen on the surface. <br /> REGULATION GUIDANCE: Diked areas must be sufficiently impervious to contain discharged oil. Construct all bulk <br /> storage tank installations(except mobile refuelers and other non-transportation-related tank trucks)so that you <br /> provide a secondary means of containment for the entire capacity of the largest single container and sufficient <br /> freeboard to contain precipitation.You must ensure that diked areas are sufficiently impervious to contain <br /> discharged oil. Dikes, containment curbs, and pits are commonly employed for this purpose.You may also use an <br /> alternative system consisting of a drainage trench enclosure that must be arranged so that any discharge will <br /> terminate and be safely confined in a facility catchment basin or holding pond. <br /> CORRECTIVE ACTION: Immediately provide or repair all diked areas to be sufficiently impervious to contain oil. <br /> Remove the water from the secondary containment and dispose of it properly. Submit proof to EHD demonstrating <br /> that the secondary containment was properly drained. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Conducted an aboveground Petroleum Storage Act (APSA) inspection. Three violations noted during the <br /> insepction.
