This bill adds <br />sections to the California Health and Safety Code relating to public swimming pools. These new sections <br />incorporate provisions of the Federal Virginia Graeme Baker (VGB) Act into California State law and are <br />intended to prevent suction drain entrapments and drownings in public pools. The new law requires that <br />all public pools be retrofitted with approved drain covers manufactured after December 19, 2008. In <br />addition, every suction drain on a public pool must have a split (dual) drain, or be equipped with a safety <br />vacuum release system or an automatic pump shut-off system. <br />The San Joaquin County Environmental Health Department (EHD) is required to administer and enforce <br />the new State law throughout San Joaquin County as follows: By July 1, 2010 owners/operators of all <br />public swimming pools and spas were to submit a work plan to upgrade their pool, along with a <br />review fee to the EHD, indicating the scope of work to be performed. In accordance with the new <br />State law, pools that were not in compliance by July 1, 2010 were to be subject to closure. <br />Two notification letters have been mailed to all public pool facility owners/operators over the past two <br />years. The letters were intended to notify the owners/operators of public pools of the new law and the <br />requirement to upgrade their pools. <br />At this time, our records indicate that your pool/spa/wade pool is not yet in compliance with the <br />new law. As stated above, a pool upgrade work plan must be submitted to our department for <br />review and approval. If the drain upgrades are not completed by May 27, 2011, your pool, spa, or <br />wade pool can no longer operate and the pool/spa will be closed. <br />Enclosed is a VGB fact sheet that provides further information about the law and guidance for your <br />work plan submittal. <br />If you have any questions, please contact Jeff Carruesco, REHS Program Coordinator, at (209) 468-3438, <br />or Vidal Pedraza, Senior REHS, at (209) 468-0334.
