OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required. -The SPCC plan states that the STI SP001 is being used for monthly tank inspections but a different checklist was shown for monthly tank inspections while on site. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or "Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2)Violation. 51 Code of Fed Regulations 112.8(c)(3)4030006- Rainwater in diked areas is inspected before draining. OBSERVATION: Facility failed to ensure to keep bypass valve normally sealed closed, inspect the retained rainwater, open and reseal bypass valves under responsible supervision before allowing drainage of uncontaminated rainwater from a diked area. REGULATION GUIDANCE: (c)(3)Not allow drainage of uncontaminated rainwater from the diked area into a storm drain or discharge of an effluent into an open watercourse, lake, or pond, bypassing the facility treatment system unless you: (i) Normally keep the bypass valve sealed closed. (ii) Inspect the retained rainwater to ensure that its presence will not cause a discharge as described in § 112.1(b). (iii)Open the bypass valve and reseal it following drainage under responsible supervision. CORRECTIVE ACTION: Ensure that rainwater is inspected before being discharged from diked areas. Keep all bypass valves customarily closed—sealed following drainage under responsible supervision. Submit proof of correction to the EHD. This is (Class 2)Violation. 52 Code of Fed Regulations 112.8(c)(3)(iv)4010026-Records maintained of drainage from diked areas. OBSERVATION:Adequate records of drainage of uncontaminated rainwater from diked areas (or NPDES permit records)of drainage were not found on site. REGULATION GUIDANCE: (c)(3)(iv)Keep adequate records of such events,for example, any records required under permits issued in accordance with §§ 122.410)(2)and 122.41(m)(3)of this chapter.
