In implementing the spill prevention control <br /> and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in <br /> Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br /> CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br /> This is (Class 2)Violation. <br /> 51 Code of Fed Regulations 112.8(c)(3)4030006- Rainwater in diked areas is inspected before draining. <br /> OBSERVATION: Facility failed to ensure to keep bypass valve normally sealed closed, inspect the retained rainwater, <br /> open and reseal bypass valves under responsible supervision before allowing drainage of uncontaminated rainwater <br /> from a diked area. <br /> REGULATION GUIDANCE: (c)(3)Not allow drainage of uncontaminated rainwater from the diked area into a storm <br /> drain or discharge of an effluent into an open watercourse, lake, or pond, bypassing the facility treatment system <br /> unless you: (i) Normally keep the bypass valve sealed closed. (ii) Inspect the retained rainwater to ensure that its <br /> presence will not cause a discharge as described in § 112.1(b). (iii)Open the bypass valve and reseal it following <br /> drainage under responsible supervision. <br /> CORRECTIVE ACTION: Ensure that rainwater is inspected before being discharged from diked areas. Keep all bypass <br /> valves customarily closed—sealed following drainage under responsible supervision.
