OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required. -SPCC plan mentioned the site has overfill prevention in the form of a liquid gauge but it was not found on site. -SPCC plan mentioned that the secondary containment has a drain but according to Anthony Fuentes the secondary containment does not have a drain. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or "Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2)Violation. 7 Code of Fed Regulations 112.5(a), 112.5(b)4010010- Facility has amended SPCC as necessary. OBSERVATION:The facility failed to amend the Spill Prevention, Control, and Countermeasure(SPCC) Plan within six months of when there was a change in design, construction, operation, or maintenance, which affects the facility's discharge potential. -SPCC plan does not adequately reflect current overfill prevention method. Plan indicates that a liquid gauge is being used to monitor tank, a liquid gauge was not found while on site. REGULATION GUIDANCE: (a)Amend the SPCC Plan for your facility in accordance with the general requirements in § 112.7, and with any specific section of this part applicable to your facility,when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge as described in§ 112.1(b). CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. This is(Minor)Violation. 50 Code of Fed Regulations 112.8(c)(2)4030013-Containment systems are sufficiently impervious to contain oil. OBSERVATION: Diked area is not impervious to contain discharged oil. Diked areas must be sufficiently impervious to contain discharged oil.
