OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required. -SPCC Plan is not implemented for training, testing and inspections, drainage of secondary containment structures, and record keeping. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter “SPCC Plan” or “Plan”),” in accordance with § 112.7 and any other applicable section. 25270.4.5.(a): An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2) Violation. 3 Code of Fed Regulations 112.7(a)(2) 4010014 - Environmental Equivalence, if claimed, is addressed in SPCC, other than for secondary containment.. OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to include a section on environmental equivalence. -The cross reference page is missing a reference for environmental equivalence. -The environmental equivalence section of the SPCC Plan should refer to other sections of the plan (overfill prevention and integrity testing) where environmental equivalence is discussed. REGULATION GUIDANCE: (2) Comply with all applicable requirements listed in this part. Except as provided in § 112.6 (Qualified Facilities Plan Requirements), your Plan may deviate from the requirements in paragraphs (g), (h)(2) and (3), and (i) of this section and the requirements in subparts B and C of this part, except the secondary containment requirements in paragraphs (c) and (h)(1) of this section, and §§ 112.8(c)(2), 112.8(c)(11), 112.9(c)(2), 112.9(d)(3), 112.10(c), 112.12(c)(2), and 112.12(c)(11), where applicable to a specific facility, if you provide equivalent environmental protection by some other means of spill prevention, control, or countermeasure.
