Such briefings must highlight <br />and describe known discharges as described in § 112.1(b) or failures, malfunctioning components, and any recently <br />developed precautionary measures. <br />CORRECTIVE ACTION: Discharge prevention briefings for oil handling personnel must be scheduled and conducted at <br />least once a year to assure adequate understanding of the SPCC Plan for that facility. Conduct all required spill <br />prevention briefings. Provide compliance verification to the EHD. <br />This is (Minor) Violation. <br />Code of Fed Regulations 112.7(e), 112.8(c)(6) 4030014 - Tanks inspected and tested by qualified person in accordance <br />with industry standards. <br />OBSERVATION: Facility failed to ensure that tanks are inspected and tested by an appropriately qualified person in <br />accordance with industry standards. The tanks were not inspected on an annual and monthly basis. The monthly <br />inspection were last done on 11/02/2021. <br />REGULATION GUIDANCE: 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular schedule <br />and whenever you make material repairs. <br />CORRECTIVE ACTION: Immediately ensure that all tanks are inspected and tested by an appropriately qualified <br />person in accordance with industry standards. Submit proof of correction/ test results to the EHD. <br />This is a repeat violation (Class 2) Violation. <br /> 55 <br />Code of Fed Regulations 112.1(b)(3), 112.2 4030036 - All/any permanently closed tanks are properly closed under the <br />definition in 40 CFR 112.2. <br />OBSERVATION: According to Mr. Rich Abalos- (Electrician II), one 5000 gallon split tank for diesel-3000 gallon and <br />gasoline -2000 gallon was not in use effective October 1, 2021 and has not been properly closed. <br />REGULATION GUIDANCE: When a tank is not in use, it must be permanently closed by meeting the following <br />conditions: <br />- remove all liquid and sludge from each container and connecting line <br />- disconnect and blank off all connecting lines and piping have from the tank / container - close and lock all valves <br />- post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br />CORRECTIVE ACTION: Tanks that are not being used or are not addressed in the Spill Prevention , Control, and <br />Countermeasure (SPCC) Plan must either be included in your plan or meet the permanent closure requirements noted <br />above. Provide verification to the EHD of proper closure of the tanks. <br />This is (Minor) Violation. <br /> 77 <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 07/27/2024. <br />Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($162).
