OBSERVATION:The facility failed to review and evaluate the Spill Prevention, Control, and Countermeasure(SPCC) plan every 5 years. According to records on site,the SPCC Plan was previously reviewed on 11/29/2018 and the most recent review was completed on 01/12/2024. REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a)of this section, complete a review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; or, if your facility was in operation on or before August 16, 2002,five years from the date your last review was required under this part.As a result of this review and evaluation,you must amend your SPCC Plan within six months of the review to include more effective prevention and control technology if the technology has been field-proven at the time of the review and will significantly reduce the likelihood of a discharge as described in§ 112.1(b)from the facility. You must implement any amendment as soon as possible, but not later than six months following preparation of any amendment. You must document your completion of the review and evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The following words will suffice, "I have completed review and evaluation of the SPCC Plan for(name of facility)on (date), and will (will not)amend the Plan as a result." CORRECTIVE ACTION: Submit documentation to the Environmental Health Department demonstrating how the facility will ensure compliance moving forward. This is (Class 2)Violation. 34 Code of Fed Regulations 112.7(g)4030001 -Handling areas, valves, pumps/starter controls, load/unload connections secured, lighting adequate. OBSERVATION:The facility failed to implement security measures listed in the SPCC Plan. The secondary containment storm water drain valve located at the 10,000 gallon diesel tank was not locked as specified by the SPCC plan. REGULATION GUIDANCE: Describe in your Plan how you secure and control access to the oil handling, processing and storage areas; secure master flow and drain valves; prevent unauthorized access to starter controls on oil pumps; secure out-of-service and loading/unloading connections of oil pipelines; and address the appropriateness of security lighting to both prevent acts of vandalism and assist in the discovery of oil discharges. CORRECTIVE ACTION: Ensure that the following security measures are implemented at the facility. Secure drain valves and provide proof of correction to the EHD. This is(Class 2)Violation. 46 Code of Fed Regulations 112.8(c)4010029-Adequate discussion of all bulk storage containers located at the facility. OBSERVATION:The facility failed to adequately discuss in the SPCC Plan all applicable bulk storage containers.
