Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />June 20, 2024 <br /> Facility Address: <br /> 2420 E EIGHT MILE RD, STOCKTON <br /> Facility Name: <br /> EASY FUEL <br /> □ OUT □ R □ COS4045 - Release/Leaks/Spills - General Local Ordinance 86 <br /> □ OUT □ R □ COS4050 - Abandonment/Illegal Disposal/Unauthorized Treatment - General See below 87 <br /> □ OUT □ R □ COS4055 - Abandonment/Illegal Disposal/Unauthorized Treatment - General Local Ordinance 88 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />Code of Fed Regulations 112.5(a), 112.5(b) 4010010 - Facility has amended SPCC as necessary. <br />OBSERVATION: The facility failed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan within six <br />months of when there was a change in design, construction, operation, or maintenance, which affects the facility’s <br />discharge potential. <br />- the facility no longer uses the checklist in Appendix C for Secondary Containment Inspections <br />REGULATION GUIDANCE: (a) Amend the SPCC Plan for your facility in accordance with the general requirements in <br />§ 112.7, and with any specific section of this part applicable to your facility, when there is a change in the facility <br />design, construction, operation, or maintenance that materially affects its potential for a discharge as described in § <br />112.1(b). <br />CORRECTIVE ACTION: Ensure that the SPCC Plan has been amended, as required, and it accurately represents <br />facility design, procedures, and policies currently in place. Provide proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 7 <br />Code of Fed Regulations 112.7 4010012 - SPCC in writing, follows code seq/cross ref, good eng practice, mgt <br />approval, items not in place. <br />OBSERVATION: The SPCC plan does not include adequate cross-reference: <br />- Section 3.2.2.1 references "Table 4" but the table is not included. <br />REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in <br />accordance with good engineering practices. The Plan must have the full approval of management at a level of <br />authority to commit the necessary resources to fully implement the Plan. <br />CORRECTIVE ACTION: Ensure that your SPCC Plan complies with the following requirements:1. It follows the <br />required SPCC rule sequence and/or includes adequate cross-reference. 2. It is prepared in accordance with good <br />engineering practices. 3. Has the full approval of management at a level of authority to commit the necessary <br />resources to fully implement the SPCC plan. 4. The plan is in writing. 5. The plan addresses additional <br />procedures/methods/equipment not yet fully operational. Provide proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 11 <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 7/20/24. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of <br />having them sign.
