Special Circumstances . Because of the special circumstances applicable to the property , including size , shape , topography , <br /> location , or surroundings , the strict application of the regulation deprives the property of privileges enjoyed by other property in the <br /> vicinity and under identical zoning classification . <br /> There are 42 parcels that are below the zone minimum of 40 acres within a one - half mile radius of this site and only 6 <br /> FExhibit <br /> ithin the one - half mile radius that are 40 acres or larger . The strict application of Development Title Section <br /> ( a ) ( 1 ) only allows 6 parcels within one - mile of this site to create a homesite parcel and deprives 87 . 5 % of the parcels <br /> - half mile ( including this site ) the property privileges enjoyed by other properties in the vicinity . ( See Variance <br /> C " ) . All of the properties in the vicinity are zoned AG -40 . <br /> [less <br /> etriment . The Variance will not be detrimental or injurious to property or improvements in the vicinity of the subject property , <br /> public health , safety or general welfare . <br /> nce will not be detrimental or injurious to other properties in the vicinity given the number of existing parcels that <br /> an the 40 acre zone minimum which are improved with single family residences . The creation of one additional parcel will not <br /> adversely affect the public health , safety or general welfare of the vicinity and is consistent with the existing character <br /> of the vicinity . <br /> 3 . No Special Privileges . The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations <br /> upon other properties in the vicinity and zone in which the property is situated . <br /> The granting of the variance will not constitute a grant of special privileges since the majority of the existing parcels ( 87 . 5 % ) <br /> are below the 40 acre zone minimum already .
