Environmental Health Department <br />CP22 - HMBP Inspection Report <br />Date: <br />July 29, 2024 <br /> Facility Address: <br /> 134 E CHARTER WAY, STOCKTON <br /> Facility Name: <br /> KENTUCKY FRIED CHICKEN #237 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is (Minor) Violation. <br />CA Health and Safety Code 25505(a)(4) 1020001 - Established and electronically submitted adequate training <br />program. <br />OBSERVATION: A training program was lacking or insufficient . Per Nicole Ruvalcava, stated they had not received <br />training for the store. When questioned about the procedures for the carbon dioxide (CO2), employee were not able to <br />answer. <br />REGULATION GUIDANCE: Training programs for all employees and annual training , including refresher courses, shall <br />include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened <br />release of a hazardous material. Training shall cover, but not limited to, all of the following: (A) Immediate notification <br />contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures <br />for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or <br />the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. These <br />training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and <br />submit to the EHD for approval. <br />This is (Minor) Violation. <br /> 13 <br />CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br />for a minimum of three years. <br />OBSERVATION: Requested for training records. Records could not be provided. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the <br />unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential <br />harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate <br />notice, for the business site. This training shall be documented electronically or by hard copy and shall be made <br />available for a minimum of three years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is (Minor) Violation. <br /> 14 <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 5 violations during the <br />inspection.
