REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information <br />required by this article, and the site map required by this section shall be readily available to personnel of the <br />business or the unified program facility with responsibilities for emergency response or training pursuant to this <br />section. CORRECTIVE ACTION: Violation Corrected onsite. Isaac Felicitas, Onsite Maintenance Manager was <br />given access to the HMBP in CERS. <br />This is (Minor) Violation. <br /> 3 <br />CA Health and Safety Code 25508.2 1010008 - Business plan reviewed and electronically certified as <br />complete/accurate on or before the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental <br />Reporting System (CERS) annually by the due date, January 15. The business plan was submitted late for this year <br />on 03/28/2024. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of <br />each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: <br />Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by <br />January 15. <br />This is a repeat violation (Class 2) Violation. <br /> 4 <br />CA Health and Safety Code 25508.1(a)-(f) 1010006 - Updated within 30 days of 100% increase or new haz; change of <br />address/owner/name; or change in ops. <br />OBSERVATION: John Arias, Shop Supervisor has not worked for the facility since October last year and he is still <br />listed as a secondary emergency contact under the facility owner/operator identification page in CERS. Also, He is <br />listed as the alternate emergency coordinator under the contingency plan section in CERS. The business has not <br />updated and submitted the information within 30 days. <br /> REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in <br />the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A <br />change of business or facility address d) Change business ownership e) Change of business name f)(1) A <br />substantial change in the handler's operations occurs that requires modification to any portion of the business plan.
