OBSERVATION: According to Mr. George Prasad (Store Manager) the alternate emergency coordinator mentioned in the business identification form have not been working for the facility for more than 30 days and the sections in CERS have not been updated. REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials. c) A change of business or facility address . d) Change business ownership. e) Change of business name. f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is (Minor) Violation. 5 CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records for a minimum of three years. OBSERVATION: Employee's training records were not available for inspection. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years.
