Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />September 23, 2024 <br /> Facility Address: <br /> 1002 EMBARCADERO , STOCKTON <br /> Facility Name: <br /> NAUTILIS DATA TECHNOLOGIES <br /> □ OUT □ R □ COS4045 - Release/Leaks/Spills - General Local Ordinance 86 <br /> □ OUT □ R □ COS4050 - Abandonment/Illegal Disposal/Unauthorized Treatment - General See below 87 <br /> □ OUT □ R □ COS4055 - Abandonment/Illegal Disposal/Unauthorized Treatment - General Local Ordinance 88 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />Code of Fed Regulations 112.3, 112.6 4010057 - SPCC plan has been prepared that meets all applicable <br />requirements. <br />OBSERVATION: The facility failed to prepare an SPCC Plan that meets all applicable requirements. <br />- Facility diagram does not mark the location and contents of each fixed oil storage container <br />- Physical layout of facility is not accurately described in SPCC plan, in Section 2.3 of SPCC Plan, TWO Material <br />Storage Areas (MSAs) are referenced, in the facility diagram only one MSA is indicated . <br />REGULATION GUIDANCE: 25270.4.5 (a) Except as provided in subdivision (b), the owner or operator of a storage tank <br />at a tank facility subject to this chapter shall prepare a spill prevention control and countermeasure plan applying good <br />engineering practices to prevent petroleum releases using the same format required by Part 112 (commencing with <br />Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, including owners and <br />operators of tank facilities not subject to the general provisions in Section 112.1 of those regulations. An owner or <br />operator specified in this subdivision shall conduct periodic inspections of the storage tank to ensure compliance with <br />Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. <br />In implementing the spill prevention control and countermeasure plan, an owner or operator specified in this subdivision <br />shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1) of <br />Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. 112.3: The owner or operator or an onshore <br />or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and <br />Countermeasure Plan in accordance with § 112.7 and any other applicable section of this part. <br />CORRECTIVE ACTION: Ensure that facility's SPCC plan meets all applicable requirements. Submit proof of correction <br />to the EHD <br />This is (Minor) Violation. <br /> 2 <br />Code of Fed Regulations 112.3 4030038 - SPCC has been implemented. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan was not implemented, as required <br />for the following reasons: <br />- SPCC plan mentions that the inspection schedule and forms in Appendix E will be utilized , which discusses a <br />weekly inspection, monthly inspection and annual inspection. At the time of inspection the above mentioned <br />inspections are not being conducted using the forms provided in Appendix E . Per Robert Adams, an inspection is done <br />twice a day and the results are recorded on an online platform. <br />- SPCC Plan mentions that "Tanker truck loading /unloading procedures in Appendix C must be posted at the loading <br />and unloading areas", Appendix C was not found posted in the mentioned areas. <br />- In Section 5.0 of SPCC plan, it is mentioned that the "Records of the inspections and tests, signed by the <br />appropriate supervisor or inspector, must be kept with the SPCC plan for at least three years".
